The short answer
A vaststellingsovereenkomst is an agreement to end employment by mutual consent. It can settle wages, leave, compensation and other claims.
Understand what you are being asked to agree
It is not just an administrative acknowledgement. Check who proposed termination, the stated reason, the notice period and whether you waive further claims. If you are ill, seek individual advice before signing because benefit rights can be affected.
Compare the agreement with your actual records
List unpaid wages, holiday allowance, unused leave and any disputed deductions. Discuss compensation separately: mutual termination does not automatically produce the statutory transition payment, although compensation can be negotiated. Check housing and insurance consequences outside the employment agreement as well. A statutory reconsideration period can apply; get advice promptly rather than waiting until the end date.
What to do next
- Take a copy of the proposal and do not sign under time pressure.
- Have an independent adviser check the terms and benefit consequences.
- Confirm payment dates, notice and the handling of unresolved claims.
An offer includes one lump sum and a clause saying all claims are settled. Ask whether that sum includes already-earned wages and unused leave before treating the entire amount as extra compensation.
Questions people ask
Is a settlement agreement the same as resignation?
No, but wording and circumstances can affect benefits. Check that the agreement accurately records who initiated termination and why.
Do I automatically receive a transition payment?
Not under every mutual termination agreement. Compensation can be negotiated; compare the offer with advice on your legal position.
Can I change my mind after signing?
A statutory reconsideration period can apply. Contact an adviser immediately to establish the deadline and written withdrawal procedure for your agreement.
Does the agreed end date affect WW?
Yes. The applicable notice period matters for when WW can start. An earlier contractual date does not necessarily bring benefits forward.
Should I sign while sick?
Get individual advice first. Ending employment during illness can harm wage and benefit rights.
